How to Transfer a FCC 3.65 License

Solution Description:

This article provides information on how to file an Assignment of Authorization application online in the Universal Licensing System (ULS).�

Please be sure to review the section on Consummation (located after the filing steps) for further details on consummation procedures.

Steps to Filing an Assignment of Authorization Application in the ULS
- Assignor (the entity who currently holds the authorization, i.e., the Licensee). The filing of an assignment begins with the Assignor and is sent to the Assignee. Once the application is completed by the both the Assignor and Assignee, the Assignor will submit the application to the FCC.
- Assignee (the entity to whom the authorization is to be assigned). The Assignee will complete its part of the application and send the application back to the Assignor to certify and submit to FCC.

Assignor Filing Steps Part 1

Log in to https://wireless2.fcc.gov/UlsEntry/licManager/login.jsp " target="_blank"> https://wireless2.fcc.gov/ UlsEntry/licManager/login.jspwith your FCC Registration Number (FRN) and Password

If you do not know the password, click on the Contact Tech Support link, and then click the Reset Password button to follow the prompts for resetting the password.

1. On the left-side of the screen, click Assign Authorization 
2. Answer the Partitioning and Disaggregation question and click Continue 
3. Answer the Full Assignment/Partial Assignment question and click Continue 
4. Select the licenses and click Add

Note: If filing a pro forma assignment skip to step 12 and click Continue to Certify, then continue to step 15. In a non-pro forma assignment, the actual controlling party changes from the current controlling interest holder to a new entity. In a pro forma assignment, the actual controlling party does not change. For example if the licensee converts from a corporation to a partnership or a limited liability company, the assignment is pro forma. Another example of a pro forma assignment is when a license that had been held by one subsidiary of a parent company is assigned to another subsidiary of that same parent company. 5. Click Continue to navigate through the application
6. On the Summary Screen you can view/edit information then go to the bottom and click Send To Assignee
Note: The Edit buttons allow you to update information and the View buttons allow you to see information, but not make changes.

7. On the left side of the screen, click Assignments
8. On the right-side of the screen, click Continue under Work on This Application 
9. On the Summary screen you need to click Edit to complete the required sections

Note: The Edit buttons allow you to update information and the View buttons allow you to see information, but not make changes.

10. Click Approve and Certify
11. Sign your application and click Send To Assignor
Note: By typing your first and last name in the name fields you have signed your application and certified to its accuracy.

Assignor Filing Steps Part 2

12. Log in to https://wireless2.fcc.gov/UlsEntry/licManager/login.jsp " target="_blank"> https://wireless2.fcc.gov/ UlsEntry/licManager/login.jspwith the Assignor's FCC Registration Number (FRN) and password 
13. On the top right of the screen, click Continue under Work Application
Note: If you are taken to a list of Saved applications, click the file number of the assignment application and complete step 15.
14. Click Approve and Certify 
15. Sign your application and click Submit Application 
Note: By typing your first and last name in the name fields you have signed your application and certified to its accuracy.

Consummation

As a general rule, assignments of wireless licenses may not be consummated without prior FCC approval. There are limited exceptions. If an assignment is pro forma, the application may be filed within 30 days after consummation, provided all of the licenses on the application are all common carrier, e.g., commercial mobile radio or common carrier fixed microwave. (Please note, in this regard, that certain licenses that are used in support of common carrier/commercial mobile radio services are not themselves common carrier/commercial mobile radio.)

Additionally, applications for involuntary assignments may be filed 30 days after consummation. Involuntary transactions are triggered by the death or bankruptcy of the licensee. Lastly, certain transactions may be consummated upon the filing of the application, without waiting for FCC approval, if all of the licenses on the application are eligible for temporary conditional authority under Section 90.159(c) of the Commission's Rules. Application Status: Applications will appear the next business day (or two businesses days later for applications filed on a weekend or federal holiday) in ULS Application Search at http://wireless2.fcc.gov/UlsApp/ApplicationSearch/searchAppl.jsp " target="_blank"> http://wireless2.fcc.gov/ UlsApp/ApplicationSearch/ searchAppl.jsp. Enter the file number in the ULS Application Search to find your application.

NOTE: Applicants will NOT be notified when the application is set to a Consented To status; applicants should track the status of their application online in order to determine when a Notification of Consummation application needs to be filed.

Unless the assignment is involuntary or is both pro forma and consists solely of common carrier licenses, the assignee must file a notification of consummation within 30 days of actual consummation and within 180 days of public notice of the FCC's consent to the application (unless the assignee files for an extension of time to consummate within the 180-day period and the FCC grants the extension).
